KinetiQ
Terms of Use
These Terms of Use govern your access to and use of the KinetiQ mobile application and related services. By creating an account, accessing, or using KinetiQ, you agree to these Terms. Your use of KinetiQ is also governed by our Privacy Policy, which describes how we collect and use your information.
1. What KinetiQ Provides
KinetiQ provides AI-assisted sports motion analysis, feedback, and coaching-style guidance based on video, audio, and related inputs that you choose to provide.
2. Informational Use Only
KinetiQ is provided for informational and educational purposes only. KinetiQ does not provide medical advice, diagnosis, treatment, rehabilitation advice, injury prevention guarantees, or professional coaching services.
AI-generated analysis can be incomplete, inaccurate, delayed, or inappropriate for your specific skill level, environment, physical condition, or equipment.
3. Health and Safety Warning
You are responsible for your own training decisions and physical safety. Stop training immediately if you feel pain, dizziness, discomfort, instability, or any other concerning symptom.
If you have an injury, suspect an injury, are recovering from one, or are unsure whether an activity is safe for you, consult a qualified physician, athletic trainer, physical therapist, or coach before relying on KinetiQ feedback.
4. User Responsibility
- You are responsible for how you interpret and use any analysis, recommendation, or coaching guidance.
- You are responsible for ensuring your environment, equipment, and activity are safe and appropriate.
- You should not rely on KinetiQ as your sole basis for health, safety, or training decisions.
5. Account Security and Eligibility
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity occurring under your account, and you may not share your account or transfer it to anyone else.
KinetiQ is a general-audience sports app. If you are under the age of digital consent in your country (for example, 13 in the United States or 16 in parts of the European Economic Area), you may use KinetiQ only with the involvement of a parent or guardian who agrees to these Terms on your behalf. By using KinetiQ, you represent that you meet these requirements.
6. Your Content
You retain ownership of the videos, audio, and other content you submit ("Your Content"). You grant KinetiQ a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, analyze, modify (for example, to generate skeleton overlays and thumbnails), and display Your Content solely for the purpose of operating, providing, securing, and improving the service for you.
You represent and warrant that you have the rights necessary to submit Your Content and to grant the license above, including any consent required from other people who appear in your videos. The license ends when you or we delete Your Content, except for backup copies retained for a reasonable period and any anonymized or aggregated information that no longer identifies you.
7. Acceptable Use
You agree not to misuse KinetiQ, including by:
- Using the service in a way that violates law or the rights of others.
- Uploading content you do not have permission to use, or videos containing other identifiable people without their consent (or, for minors, the consent of a parent or guardian).
- Uploading content that is illegal, sexually explicit, harassing, hateful, or that depicts another person in a way that would violate their privacy or dignity.
- Impersonating another person or creating accounts using false information.
- Attempting to disrupt, reverse engineer, scrape, or otherwise interfere with the service or its security.
8. Free Tier, Subscriptions, and Payments
KinetiQ provides a free tier that includes a limited number of motion analyses per calendar month (currently three per month). Your remaining free analyses are shown in the app, and your monthly count resets at the start of each billing period. Once the free quota is used up, additional analyses require an active paid subscription until the next reset.
KinetiQ offers paid features through auto-renewing subscriptions sold through the Apple App Store. The subscription term, price, and available plans are shown in the app at the time of purchase. Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings.
Refunds are handled by Apple in accordance with the App Store's refund policy. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partially used subscription periods.
We may change subscription prices or plan offerings from time to time. Where required by the App Store or applicable law, price increases will not take effect for your existing subscription until you have been notified and, if required, have affirmatively consented to the new price. If you do not agree to a price change, you can cancel your subscription before the change takes effect.
9. No Warranty
To the maximum extent permitted by law, KinetiQ is provided "as is" and "as available" without warranties of any kind, whether express or implied.
10. Limitation of Liability
To the maximum extent permitted by law, KinetiQ and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from your use of or reliance on the service, including injuries, training outcomes, lost data, or service interruptions.
11. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless KinetiQ and its operators, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of KinetiQ; (b) content you submit, including any claim that your content infringes the rights of, or causes harm to, a third party (such as another person appearing in a video you uploaded); or (c) your violation of these Terms or any applicable law.
12. Suspension and Termination
You may stop using KinetiQ at any time and may request deletion of your account by contacting us. We may suspend or terminate your access to KinetiQ, with or without notice, if you violate these Terms, if your use creates risk or possible legal exposure for us or other users, or if we are required to do so by law. Sections that by their nature should survive termination (including content licenses you have granted, no warranty, limitation of liability, and dispute provisions) will survive.
13. App Store Terms
You acknowledge that these Terms are between you and KinetiQ only, and not with Apple Inc. ("Apple"). Apple is not responsible for KinetiQ or its content. Apple has no obligation to provide any maintenance or support services for KinetiQ.
In the event of any failure of KinetiQ to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to KinetiQ.
Apple is not responsible for addressing any claims by you or any third party relating to KinetiQ or your use of it, including product liability claims, claims that KinetiQ fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. If a third party claims that KinetiQ or your use of KinetiQ infringes that party's intellectual property rights, KinetiQ (and not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
You represent that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or your use of KinetiQ are governed by the laws of the jurisdiction in which KinetiQ is operated, without regard to its conflict-of-laws principles. You and KinetiQ each agree that any dispute will be resolved in the competent courts of that jurisdiction, except where applicable law gives you the right to bring proceedings in the courts of your country of residence. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your country of residence.
15. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, constitute the entire agreement between you and KinetiQ regarding the service and supersede any prior agreements.
16. Changes to These Terms
We may update, suspend, or discontinue parts of KinetiQ and may revise these Terms from time to time. Continued use after changes become effective means you accept the revised Terms.
